    A friend of mine received her PIP assessment yesterday. None MD but she has considerable difficulty walking due to another condition. Uses crutches to get about on good days, on bad days does not get about. Needs stair lift for stairs and raised toilet seats etc. apparently found to have no real mobility issues as she was awarded four point for mobility. She had attended the interview which was with a nurse, using her crutches, and I was also there. We had talked about mobility issues at length.
    Just goes to show what a complete shanbles this assessment program is.

    Sadly, not an isolated case. Will your friend be requesting a mandatory reconsideration? It is so frustrating how many flawed assessments there are, and then folk have the stress of requesting an MR and possibly an appeal.

    She is going to appeal, but is really worried in case she loses everything. She had a life time award, and now it is reviewed every couple of years. n top of that she also had to apply for UC instead of ESA when she moved. 12 weeks on she still has nothing and is living on what she can borrow. She has been told it will be another month before she hears something.
    It is beyond me how this country can treat disabled people with so much disdain. She would love to work but cannot, and because of this she is being driven close to suicide at the moment. She cannot afford to heat her home, and she eats becasue we buy her food. It makes me ashamed to be British.
    I posted really as a warning to others to not only be prepared but also be warned. The UK Government want you – as a sacrificial lamb on the altar of the bankers

    She has no one suporting her aart from Dragon and myself. Virtually no resources in this area to support anything. we have even tried to get a social worker involved (thats how desperate we have become) and after ten weeks, nothing!
    CAB is overwhelmed, job Centre do not want to know. Charities are overwhelmed too. We will keep going as long as we can.

    It’s important to remember that PIP is awarded mostly for what other people do for you and the help you need as opposed to your illness itself, and how they are intertwined. It’s a difficult one because the assessment is skewed for you to lose. The software is also multiple answer towards loss too. She should take the time now to gain recent documents from any professionals that support her need for outside help, and help from friends and relatives. It’s a mess, and the whole thing is geared towards you losing what you are entitled to. I wish her good luck with her appeal.

    It’s so easy to forget that someone else has done something for you, even putting the kettle on and making you tea because that particular day you had weak arms and hands from forcing yourself to get dressed early for a visit, and maybe overworked your muscles/yourself to the point of exhaustion. If it’s been done for you once, it’ll probably be needed on a increasing basis in the future so include it. Once is enough for it to be valid.

    Appeal and get a supporting letter from a professional.
    I got turned down but got a supporting letter and sent my own and the decision was overturned.

    Goes from bad to worse at the moment. She has been turned down for Council Tax relief as she has failed to provide sufficient evidence she is on UC. SHe would certainly do that if it had not taken her claim some 13 weeks so far. Does make you wonder about the system doesn’t it.

    So, just to update you on our never ending saga…

    We’ve received a letter from HM Courts & Tribunals Service & the form is called “Request for Tribunal directions or additional information for the Tribunal” & it would appear that it originates from HMCTS & has been sent to the DWP asking for THEIR instruction on how to proceed.

    That in itself has made my blood boil, as I am sure it will you but, the real kicker is this. It clearly states immediately underneath the name of the form “Do not copy this form to the appellant or representative“.

    It would appear that not only are tribunals asking the DWP how to proceed with cases, they’re doing it behind our backs!

    Whilst I appreciate someone has obviously sent this to us in error, it makes it obvious the tribunals are not impartial.

    Tribunals are supposed to act on & within the law & not at the will of the DWP.

    Tribunals are supposed to distribute copies of all documentation from Party to the Proceedings (PTTP) i.e. any person involved in the appeal to all involved. This is called disclosure.

    I have been forced to write to demand an explanation from HMCTS & depending on their answer, I fear I have to insist on a judicial review.

    I wish I had legal advice on this because I feel it should be brought to the attention of the wider world.

    This is not justice. It is so clearly one sided.

    WHAT A DISGRACE111 How can this be happening behind our backs, with no public knowledge. Perhaps just as importantly, what other things are going on behind the scenes that affect our welfare and we being. Surely two world wars were fought to stop this sort of thing happening.

    A further update about my friend. She was refused the mobility component of PIP as she was apparenty taking long walks, great than 500m, along the promenade. This is a woman who turned up for the interview using crutches, and needs transport pretty much anywhere. However, the more worrying thing is that long walks along the promenade were never mentioned during the interview. if that is the case, why was it (a) never discussed and (b) where did such information come from? It does seem in the light of the instance above and what has happened here there are in fact some very dirty tricks being played around these assessments.

    If the lady can’t walk mate then you’ve got to elevate it to UT.

    First things first, ask for the statement of reasons (if it’s been to FTT). If it hasn’t, ask for the DM to explain his decision then appeal that via mandatory reconsideration.

    Personally, I’ve felt it necessary to complain now to His Honour Judge (John) Aitken’s office, President of the Social Entitlement Chamber of the First-tier Tribunal with regard the Judge at FTT & the existence of this “Request for Tribunal directions or additional information for the Tribunal” form.

    I’ve also lodged a complaint with the Independent Case Examiner.

    And if I’m not satisfied with all of that then I am going to the press.

    It’s an utter scandal & national disgrace the way this government department are carrying on. They would appear a law unto themselves.

    It is a scandal and also extremely worrying. I am awaiting with a lot of trepidation, my own ‘invitation’ to apply for PIP. With the sort of goings on that you have highlighted I wonder how much fairness is actually left in this system. We shold be proud of the British sense of fairness but that mo longer seems to exist, certainly with regards to benefots matters. Such considerations do make me lose sleep at night. it is hard enought trying to deal with evryday problems as a disabled person as we all know, but dealling with such ‘darkness’ in the system that is provided to protect us does make me wonder how far it has spread.
    Do please keep us informed on this.

    I’ve scanned the document. I’m going to try & work out how to carefully place blank patches to obscure the personal, in order to redact sensitive information that could identify my wife or I.

    If anyone else knows how to do that, please advise below. Otherwise, once I’ve worked it out I’ll endeavour to show it to you all here so you can see for yourselves what goes on behind our backs.

    I’ve only discovered add-on’s for Adobe that incur quite a large cost.

    If anyone can see the text underneath I won’t leave it live for long but, I’m sure you get the gist of what I’m so upset about.

    This form is being circulated behind our backs between the tribunals & the DWP & is clearly marked not to be shared with us, the appellant (disabled) appealing a decision.

    It is treacherous.
