PIP here we come :(
So… this happened
Finally got my ‘invitation’ to claim PIP which includes a request to phone them with lots of information before the form is sent. I have till 5th May to call. Will do it next week, or the week after sometime and let you all know how the lovely process goes. I was an indefinite DLA award. Ho hum.

There’s no way to candy coat this mate, you’ve got to expect a kick in the plums & you might only get a poke in the eye. That’s the best way I can prep you for it because they don’t make it easy. Being on a lifetime award, as I was, means nothing. As far as they’re concerned, it’s a new claim & you’re starting over.
If nothing else I wish that it’s expedient because we’re into our fourteenth month with a rescheduled court date for next month. I’ve been told to keep my big mouth shut & not say more about it.

I do have some excellent support documents:
A letter from my previous employer outlining the progression of my disease to the point where the job was impossible
A letter from my consultant/surgeon/neurologist explaining my disease and how it affects me personally
A letter from two professors of genetics in Newcastle who helped (with my dna) find the faulty gene (an05) and diagnose me and others with LGMD2L from 2010
A letter from my partner explaining how the disease affects me and a few other things. I think these helped the DM award (god that word) me ESA without a face to face assessment.The main thing I hate about this disease is it’s invisibility.

If you’re on a DLA indefinite award & you’re offered a fixed period award for PIP, you have the right to challenge it & request it be amended to an indefinite should it be deemed ‘inappropriate’.
In fixing the duration of a fixed term award, relevant considerations will include the likely persistence of an individual’s limiting condition/conditions. The rigid categories for the duration of fixed term awards are not compatible with the purpose of the 2012 Act (http://www.legislation.gov.uk/ukpga/2012/5/section/88/enacted) should your daily living & mobility problems be unlikely to diminish.

Hopefully my study of welfare rules, welfare reform & EU social security coordination rules for the past fourteen months can be of some value to my fellow wobblies here

Thanks Wonder Woman I’ll print off all that and have a read. I’m very grateful for people including information in this thread and hopefully it will help others as it grows.
I know this will sound ridiculous but does anyone else feel almost embarrassed to claim what in real terms we are entitled to? It’s such a sad effect of the bad media coverage, it’s making me feel sick, but at the same time I intend to fight this all the way seeing as the politicians claim thousands of pounds of taxpayers money for garden gnomes and whatever. If my benefits are cut I’m not sure how I will survive, doesn’t bear thinking about. What world are we living in when our own Government vilify disabled people
Reply To: PIP here we come :(I know exactly what you mean Launton. I can assure you, you shouldn’t have to feel guilty but, know why you do.
You naturally feel like that because you’re a decent person being forced to fight for what you are quite rightly entitled to. It’s called social security. I used to work before I knew what my problem was & wasn’t diagnosed til I was 27 & I carried on working for nearly 4 years after that. Whilst working you pay taxes for a number of reasons, one of which is to support others less fortunate than yourself.
I didn’t expect that one day I would be one of the people that would, not benefit from but, need that same safety net & come to rely on it.
The problem in the year 2016 is not the fact you have to rely on social security, the problem is you have to fight for it. It’s part of the endemic reality living under a tory government.
So, don’t you ever feel bad. I know you will, I do but, it’s not our fault. It’s the system & the government manipulating the media. As I’ve said many times, these people are so far removed from the rest of us they wouldn’t know poverty & struggle if it hit them in the face & boy would I like to try.
